If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, customers, and others who access our website or request services from us.
Essex Insulation provides residential and commercial insulation services in Essex, VT and surrounding communities. Services include, but are not limited to, spray foam insulation, attic insulation, blown-in insulation, basement insulation, crawl space insulation, wall insulation, air sealing, vapor barrier installation, and insulation removal. The specific scope of work for any project is defined in a written estimate or proposal provided to the customer prior to the start of work.
All estimates provided by Essex Insulation are based on information available at the time of the on-site assessment. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. Prices are subject to change if the scope of work changes, if unforeseen conditions are discovered during the project, or if material costs increase significantly between the time of estimate and the scheduled start date.
An estimate does not constitute a binding contract. Work begins only after the customer has reviewed and accepted the written estimate. Any changes to the scope of work after acceptance must be agreed upon in writing before the additional work proceeds.
We schedule jobs based on crew availability and material lead times. We will provide you with a confirmed start date after you accept an estimate. We ask for at least 48 hours notice if you need to reschedule or cancel a scheduled job. Cancellations made with less than 48 hours notice may result in a rescheduling fee to cover crew and material staging costs, at our discretion.
We reserve the right to reschedule jobs due to weather conditions, material availability issues, or circumstances outside our control. In such cases, we will notify you as early as possible and offer the next available appointment at no additional charge.
Payment is due upon completion of the work unless otherwise agreed in writing prior to the start of the project. For larger projects, we may require a deposit before work begins. The deposit amount and any payment schedule will be specified in the written estimate.
Accepted forms of payment include check, bank transfer, and other methods agreed upon in writing. Invoices not paid within 30 days of the completion date may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by Vermont law, whichever is less.
If an account is placed with a collection agency or if legal action is required to collect an unpaid balance, the customer agrees to pay all reasonable collection costs and legal fees in addition to the amount owed.

Essex Insulation warrants that all work will be performed in a professional manner consistent with applicable industry standards and Vermont building code requirements in effect at the time of the project. If a defect in workmanship is identified within one year of project completion, we will return to assess and remedy the defect at no charge, provided the defect is not caused by customer misuse, modification, or conditions outside our control.
Manufacturer warranties on materials (such as spray foam products or vapor barrier materials) are separate from our workmanship warranty and are subject to the terms of the applicable manufacturer. We will provide documentation of any applicable product warranties upon request.
Except as expressly stated in these terms, Essex Insulation makes no warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. We do not warrant that our services will eliminate all energy loss, prevent all moisture infiltration, or achieve any specific energy savings result. Outcomes depend on factors including home construction, occupant behavior, climate conditions, and the presence of other deficiencies in the building envelope that are outside the scope of our work.
To the fullest extent permitted by Vermont law, Essex Insulation shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of services performed shall not exceed the total amount paid by the customer for the specific project giving rise to the claim.

If a dispute cannot be resolved informally, the parties agree to attempt good-faith mediation before pursuing litigation. Any legal action not resolved through mediation shall be brought exclusively in the courts of Vermont, and both parties consent to the jurisdiction of those courts.
These terms and conditions, and any disputes arising from them or from services provided by Essex Insulation, are governed by the laws of the State of Vermont, without regard to its conflict of law provisions.
